SEEN File No. EX-2020-39581537-APN-DGD#MPYT, Laws Nros. 24,467 and its modifications, 25,300 and its modifications and 27,264, Decree No. 50 dated December 19, 2019 and its amendments, Resolution No. 220 dated April 12, 2019 of the former SECRETARIAT OF ENTREPRENEURS AND SMALL AND MEDIUM ENTERPRISE of the former MINISTRY OF PRODUCTION AND WORK and its amendments, and
CONSIDERING:
That Law No. 24,467 and its amendments are intended to promote the growth and development of Small and Medium-sized Enterprises, promoting to this end policies of a general scope through the creation of new support instruments and the consolidation of existing ones.
That by Article 2 of the aforementioned norm, the Enforcement Authority is entrusted to define the characteristics of the companies that will be considered Micro, Small and Medium-sized Companies, being able to contemplate, when so justified, the specific characteristics of the different sectors and regions of the country and based on some, some or all of the following attributes thereof or their equivalents, employed personnel, value of sales and value of assets applied to the production process, without prejudice to the provisions of Article 83 of the aforementioned law.
That, likewise, the aforementioned Article 2 establishes that the Application Authority will annually review the definition of Micro, Small and Medium-sized Enterprises in order to update the parameters and specificities contemplated in the definition adopted.
That by Decree No. 50 dated December 19, 2019 and its amendments, the Implementation Organization Chart of the centralized National Administration was approved up to the level of the Undersecretariat and its respective objectives, among which are those corresponding to the MINISTRY OF PRODUCTIVE DEVELOPMENT, and in particular to the SECRETARIAT OF THE SMALL AND MEDIUM-SIZED ENTERPRISE AND THE ENTREPRENEURS, assigning the faculty of understanding in the application of the Laws Nros. 24,467 and its modifications and 25,300 and its modifications.
That by Resolution No. 220 dated April 12, 2019 of the former SECRETARIAT OF ENTREPRENEURS AND OF THE SMALL AND MEDIUM-SIZED ENTERPRISE of the former MINISTRY OF PRODUCTION AND WORK and its amendments, the "Registry of MyMyPhESE Companies" was created, with the purposes established in Article 27 of Law No. 24,467 and its amendments.
That Article 14 of the aforementioned resolution establishes that once the information has been analyzed and the fulfillment of certain requirements verified, the "MiPyME Certificate" will be issued, thus leaving the company registered in the MiPyMES Business Registry.
That by means of Article 3 of Resolution No. 220/19 of the former SECRETARIAT OF ENTREPRENEURS AND OF SMALL AND MEDIUM-SIZED ENTERPRISES and its amendments, the relevant characteristics were defined for the purposes of categorization and registration in the MyPyMES Business Register, among which are the limits of total annual sales, employed personnel and assets expressed in pesos.
That through Articles 5, 6 and 7 of said resolution, the categorization limits were approved according to total annual sales, employed personnel and assets, which were determined in tables A, B and C of Annex IV of the aforementioned regulation. .
That the National Directorate of Financing and SME Competitiveness of the SUB-SECRETARIAT OF FINANCING AND SME COMPETITIVENESS of the SECRETARIAT OF SMALL AND MEDIUM-SIZED ENTERPRISES AND THE ENTREPRENEURS of the MINISTRY OF PRODUCTIVE DEVELOPMENT was issued regarding the updating of the values mentioned above, raising the authority of Application a proposal through the Technical Report IF-2020-39576727-APN-DNCYFP#MPYT, ratified by the aforementioned Undersecretariat through Report IF-2020-39578671-APN-SSFYCP#MDP.
That this SECRETARIAT OF THE SMALL AND MEDIUM-SIZED ENTERPRISE AND THE ENTREPRENEURS analyzed the proposal of the said Directorate and shares the criteria expressed regarding the updating of values of the limits of total annual sales, employed personnel and assets expressed in pesos.
That, by virtue of the foregoing, it is necessary to update the values established in Annex IV of Resolution No. 220/19 of the former SECRETARIAT OF ENTREPRENEURS AND OF SMALL AND MEDIUM-SIZED ENTERPRISES and its amendments.
That the General Directorate of Legal Affairs of the MINISTRY OF PRODUCTIVE DEVELOPMENT has taken the intervention that corresponds to it.
That this measure is adopted by virtue of the powers conferred by Article 2 of Law No. 24,467 and its amendments, and Decree No. 50/19 and its amendments.
Thus,
THE SECRETARY OF THE SMALL AND MEDIUM-SIZED ENTERPRISE AND THE ENTREPRENEURS
RESOLVES:
ARTICLE 1.- Replace Annex IV of Resolution No. 220 dated April 12, 2019 of the former SECRETARIAT OF ENTREPRENEURS AND OF SMALL AND MEDIUM-SIZED ENTERPRISE of the former MINISTRY OF PRODUCTION AND WORK and its amendments, by the Annex (IF-2020- 39615371-APN-SSFYCP#MDP) that is an integral part of this measure.
ARTICLE 2.- This resolution will take effect from its issuance.
